    This website is operated by Pecopp Pest Control Services Pvt Ltd. Throughout the site, the terms “we”, “us” and “our” refer to Pecopp Pest Control Services Pvt Ltd. Pecopp Pest Control Services Pvt Ltd offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

    By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including Email marketing (if applicable): With your permission, we may send you emails about our services, new products and other updates.

    By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

    You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

    A breach or violation of any of the Terms will result in an immediate termination of your Services.

    1. Advice and recommendations:

    1. Customer shall ensure resident co-operation to move materials and enable PECOPP employees to provide pest control services.
    2. As pests can occur in any space and can spread from untreated to a treated area, PECOPP recommends that the customers help it by access to all spaces covered by the contract.
    3. PECOPP does not schedule services on its annual holidays. Customers should request for a schedule change at least twenty-four hours prior to the time confirmed for their service.
    4. Customer consents to receiving transactional information and promotional offers from PECOPP through email, SMS, WhatsApp, or other messaging platforms on the mobile number and / or email id they provided to PECOPP.

    2. Complaints and grievances:

    • In the event the customer has any complaints regarding PECOPP services under this contract, then the customer may convey the same for PECOPP redressal. Customers may choose to contact PECOPP through its website or email ID for recording their complaints.

    3. Additional services and re-treatment:

    • Annual maintenance contract (AMC) services contracts entitle customers for free additional service or re-treatment if there is any re-infestation during the contract tenure. PECOPP may ascertain the severity of the infestation and need for additional service or re-treatment by obtaining information from the customer and shall provide additional service or re-treatment only if it thinks it necessary.

    4. Pests covered:

    • PECOPP pest control services only cover those pests mentioned in its contract. Treatment of all the other pests is excluded unless agreed by PECOPP in writing.

    5. Safety instructions:

    • PECOPP services may involve use of chemical pesticides and for which its employees shall use appropriate personal protective equipment (PPE). Customers are advised to stay away from the place receiving pesticide application for their safety.

    6. Liability:

    1. PECOPP shall not be liable for damages, death, injuries, or any consequential damage of whatsoever nature to any person or property, by its services or from pests covered by the contract.
    2. Customers shall not hold PECOPP responsible for any damage to the premises during its pest control services.

    7. Termination:

    • This contract is neither terminable before the expiry period nor transferable. PECOPP shall credit customer for the residual part of their contract in case premises change and if required, the customer agrees to pay PECOPP additional amount towards the pest treatment at the new premises. PECOPP may terminate the contract with written intimation to customer.

    8. Force Majeure:

    • PECOPP shall not be responsible for any delays or failure to perform its obligations mentioned in the contract if the reason of such delay or failure is beyond its control including acts of god, pandemics, war or civil disturbances and industrial disruptions or any restrictions which may be imposed by the Government of India or State as the case may be.

    9. Tenure:

    • The services shall be valid for the duration of the contract period and shall lapse and not get carried forward if the customer fails to avail them in such period.

    10. Payment:

    • Contract charges are payable in advance and may be paid electronically by customer on signing the contract.

    11. Warranties:

    • The company does not make any verbal warranties or representations and requests customers not to accept any such information unless accompanied by PECOPP’s written confirmation.

    12. Treatment Effectiveness:

    1. PECOPP pest control services rely on the materials applied to impact pests. Customers shall not wash, paint or in any other way disturb the treated space or surface to help ensure treatment efficacy.
    2. PECOPP provides preventive steps on its website www.pecopp.com to help customers minimize pest populations at their residences which they can adopt for ensuring effectiveness of pest treatments.

    13. Termite treatment: The following clauses pertain only to termite treatment.

    1. This treatment involves drilling above the skirting of the wall or at wall-floor junction either or both which the customer shall allow.
    2. Customers shall move wooden furniture and storage units away from the wall to facilitate access and treatment of the wall.
    3. Prior to the treatment for drilling of the walls and floor customer shall provide details of concealed cabling and plumbing lines to PECOPP technicians to avoid accidental puncturing and damage.
    4. The customers shall provide electrical power for use of electrical drill and sufficient water to prepare emulsion for the treatment. The customer shall also assist by providing access to reach heights including areas above false ceiling and lofts.
    5. Customer shall not defer or deny PECOPP’s service charges for areas which were not made available for drilling by customer and which PECOPP did not treat.
    6. Customer shall ensure that all premises in the customer contract are available for PECOPP to carry out treatment. Also, the warranty shall be void for premises PECOPP did not treat for limitations of access. Customer shall delay the amount payable to PECOPP because some parts of the premises are locked, or some occupants of a residential community covered by the contract do not allow PECOPP to do the treatment.
    7. PECOPP shall do re-treatment during checkup visits for termite control only if termites reappear.
    8. Customer or their representative shall show to PECOPP technicians the ground location of the essential service pipes and cables. While its technicians bore holes in the ground, if pipes & cables are accidentally broken despite precautions, PECOPP shall not be liable for the damages.
    9. Customer shall repair all leaking water pipes, failing which PECOPP shall not be responsible for reduction in the efficacy of the termite treatment. PECOPP technician shall not visit the customer’s premises in response to any complaint at such premises, unless the customer stops the leakage.

    14. Entire Agreement:

    • These terms and conditions and any document expressly referred to herein, to constitute the whole agreement between PECOPP and customer and supersede all previous discussions, correspondence, negotiations, previous arrangements, understanding, or agreements relating to the subject matter of any Contract.

    1. PECOPP Pest Control Services Private Limited (PECOPP) agrees to provide Pest Management Services (Service or Services) at the specified areas of the customer’s premises described in the contract for the service charges plus taxes as applicable.

    2. The contract specifies the contract period and the services PECOPP shall provide to the customer.

    3. The customer’s furniture and equipment are excluded from the scope of this contract unless PECOPP agrees explicitly to their inclusion in writing.

    4. PECOPP shall make a fresh inspection and submit a quotation for customer approval for additional areas or pests for which customers want treatment.

    5. The contract covers: (i) the scheduled services to assess and, if necessary, treat the premises for managing the specified pests, and (ii) any additional services required in the unlikely event further steps are required to manage those pests in response to a customer complaint.

    6. PECOPP shall provide a service record at the time of service to the Customer.

    7. Additional service visits: In the unlikely event the customer notices fresh pests between regular PECOPP services, the customer shall immediately notify PECOPP, who shall carry out additional work to address the issue without further charge.

    8. PECOPP requires that the customer implement any actions that it had recommended for effective pest management.

    9. PECOPP shall deliver additional services only during regular business hours and for pests covered by this contract.

    10. Service charges and payment: The service charges are based on services PECOPP shall provide, allowing for initial treatment costs, materials and equipment costs, service support and administration costs (“service costs”).

    11. If PECOPP agrees to accept a reduction or cancellation of any part of the services, any variation to the charges shall account for these service costs. The customer may not vary service charges pro-rata to the change in the services.

    12. PECOPP shall periodically review its service charges and may increase them to reflect increased costs and provide the customer with at least two months prior notice of any increase in the service charges.

    13. PECOPP is registered as an MSME and shall charge interest on amounts overdue for payment at the rate specified by The Micro, Small and Medium Enterprises Development (MSMED) Act 2006.

    14. The customer shall be liable to pay all charges for services PECOPP provides as per the contract and shall not in any manner deduct or withhold any amount (whether by way of set-off, counterclaim or otherwise).

    15. Should PECOPP incur costs to a collection agency or legal fees to recover any amount the customer did not pay, the customer shall pay such fees.

    16. PECOPP reserves the right to cease all further services until customers pay all outstanding amounts they owe to PECOPP.

    17. Customers shall request a service schedule change at least twenty-four hours prior to PECOPP’s confirmation for their service.

    18. Customer consents to receiving transactional information and promotional offers from PECOPP through email, SMS, WhatsApp, or other messaging platforms on the mobile number and email ID they provided to PECOPP.

    19. Term: This Agreement shall operate for one year unless specified otherwise and shall automatically renew on mutual agreement for another year unless either party terminates it. Either party may terminate this Agreement on thirty (30) day notice given prior to the expiry of the current term.

    20. Access: The Customer will provide PECOPP with access to the premises and water or electricity areas to perform the services at agreed times. PECOPP personnel will show their identification to the customer upon request and comply with all reasonable requests while present at the premises.

    21. Pest assessment: All pest assessment in these services will be by visual inspection only and limited to those areas and sections of the customer property fully accessible and visible to PECOPP technician or other employees on the day of the inspection. Equipment and fittings may conceal pests or pest activity and may reveal pests when the customer removes items.

    22. Pests covered: The treatments will cover only those pests described in the contract. The contract excludes all other pests unless agreed by PECOPP in writing.

    23. Advice and recommendations: PECOPP’s technician will report findings in the service records after each visit, including advice and recommendations to the customer to control and minimize pests.

    24. PECOPP recommendations shall cover cleaning, storage, and maintenance. PECOPP may choose to terminate this contract if a customer fails to implement recommendations necessary to eliminate factors or conditions contributing to pest re-infestation.

    25. PECOPP provides preventive steps on its website www.pecopp.com to help customers minimize pest populations at their premises which they can adopt for ensuring the effectiveness of pest treatments.

    26. Safety Instructions: The customer must follow PECOPP technician’s safety instructions concerning pesticides and other safety instructions relevant to the services. The customer shall notify the PECOPP technician of any health and safety issues at the premises before the latter commence any service.

    27. Treatment effectiveness: PECOPP will deliver the services competently and professionally considering these terms. The ongoing effectiveness of the pest control provided depends on the customer implementing PECOPP’s recommended hygiene, storage, and maintenance actions.

    28. Pest treatment could become ineffective by the customer disturbing treated areas, changes in the surrounding environment, building alterations, renovations and introducing materials to the property that encourage pest activity. PECOPP pest management services rely on the materials applied to impact pests. Customers shall not wash, paint or in any other way disturb the treated space or surface to help ensure treatment efficacy.

    29. Equipment: The customer agrees to take reasonable care of equipment installed at their premises by PECOPP as part of the services and follow any instructions given by PECOPP in relation to the equipment and its use.

    30. All equipment shall remain the property of PECOPP, and the Customer agrees not to move or modify the equipment, including removing any label indicating the equipment belongs to PECOPP.

    31. The Customer accepts all costs of rectifying damage they cause to PECOPP equipment, including loss, theft or damage caused by fire.

    32. The customer agrees to inform PECOPP if someone damages or removes PECOPP equipment immediately.

    33. On termination of this contract for any reason, the customer shall provide access to the premises to allow PECOPP to remove its equipment.

    34. Damage to Utilities: If delivery of the services as per contract requires drilling or cutting any materials, the customer shall identify the location of all utility services to the property, including water and drainage pipes, electrical and telephone cables, and gas pipes.

    35. PECOPP shall exercise due care in performing any drilling or cutting. Still, the customer shall be liable for any damage caused by penetration to any such services unless PECOPP employee’s negligence causes such damage.

    36. Reliance on service and report: PECOPP provides its reports and records solely for the customer’s benefit, whose name is in the report. The customer cannot assign either this contract or any report to another person without PECOPP’s prior written approval that it may give conditionally or withhold.

    41. Subcontractors and Agents: PECOPP may engage or employ any person, subcontractor, or agent to provide any Services under this contract.

    42. Entire contract: This contract contains the entire understanding of the parties, and all other terms, representations, conditions, guarantees, undertakings, and warranties, including liability for negligence which might have been implied by law or have any application, are expressly excluded from the fullest extent permitted by law.

    43. Liability: PECOPP provides its services only for the benefit of the customer. PECOPP accepts no responsibility, whether in contract, tort or otherwise, including in relation to negligence, to any third party because of the provision of the services or any report provided concerning the agreement.

    44. To the extent permitted by law, PECOPP’s total aggregate liability to the Customer under or in relation to this contract and the services (including in contract, negligence, tort or any common law or statutory right) is limited, at PECOPP’s option, to the resupply of the service or the cost of resupply of the service.

    45. Inability to deliver services: PECOPP shall not be responsible for any delay or failure in meeting its obligations if the failure results from a cause beyond its control, including acts of God, storms or floods, war or civil disturbances, lockdown, pandemic, industrial disruption, or accidents involving the loss or breakdown of plant, equipment or facilities required for PECOPP’s services.

    46. Governing Law: This contract is governed by the laws of the Union of India and both parties submit to the jurisdiction of the courts of Mumbai.

    47. In the event of any disputes arising out of work carried out by PECOPP under these terms and conditions, both parties shall attempt to reconcile to conciliation through mediation. If the dispute is not amicably resolved, the affecting party may approach the Court of Law in Mumbai only. The courts of Mumbai will have exclusive jurisdiction. Both parties shall bear their costs of litigation unless otherwise directed by the Court.

    48. If the customer fails or delays paying its dues, PECOPP shall have the right to approach MSME Samadhan Council or any such body that the Government of India may appoint to recover its dues.

    We reserve the right to refuse service to anyone for any reason at any time.

    You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
